CARD POLICY

OFFICIAL REGULATION

SECTION 1. ORGANIZER AND OFFICIAL REGULAITON OF THE PROGRAM
This loyalty program is organized and carried out by: SC El Unico Paradis SRL, headquartered in Otopeni city, Ifov County, Str. Drumul Garii Otopeni no.6, registered with Trade Registry Office near Bucharest Tribunal under no. J23/407/2001, sole registration code 13915420, fiscal attribute RO, represented by Director Karim Allan Bandack
Hereafter referred to as the “Organizer”.

The participants to the Program are obliged to comply with the terms and conditions of the Official regulation, according to the elements mentioned below (hereafter referred to as „Official Regulation”).
The Official regulation is available to any participant to the program, for consulting, in any of  El Unico and La Casa del Habano shops and on the websites (www.lacasadelhabano.ro and www.el-unico.ro) participating to the program.

SECTION 2. AREA FOR THE CARRYING OUT OF THE PROGRAM
The loyalty program is organized in El Unico and La Casa del Habano shops on the entire Romanian territory, with a possibility of extension of its carrying out to other partners too.
 
SECTION 3. DURATION OF THE PROGRAM
It shall be launched on the 1st of November 2009, it has indefinite duration and shall be carried out in accordance with the provisions of the hereby Official Regulation.
 
SECTION 4. CONDITIONS OF PARTICIPATION
The program can include natural persons over 21 years and/or legal persons, active clients and/or new clients that apply for the El Unico card. Their enrollment in the program is made by filling in and signing the enrolment form*. The enrolment form is accessible in any of the El Unico and La Casa del Habano shops or in the program partner location s.
In order to be identified and introduced in the loyalty program the participant must fill in all the fields marked as mandatory in the enrolment form. The enrolment form shall be filled in and delivered in El Unico, La Casa del Habano shops, on e-mail or in other locations agreed by the Organizer.
*According to the requirements of the law 677/2001 for the protection of persons  regarding the processing of the private data and free circulation of these data, amended and supplemented and of the law 506/2004 on the processing of private data and protection of private life in the sector of electronic communication, SC EL UNICO PARADIS, as operator, undertakes the obligation to administrate under safety conditions and only for the specified purposes, the personal data that the participants to the program supply.
 
SECTION 5. MECHANISM OF DISCOUNTS
The client benefits from discounts against the price displayed in El Unico, La Casa del Habano shops and in the program partner locations, for the products selected by the Organizer to be part of the Loyalty Program. The discount can be unilaterally amended by the organizer by public notice, the publication on the sites www.el-unico.ro and www.lacasadelhabano.ro being sufficient. The list of the products excepted from this program shall be attached to the Regulation. This list shall be periodically updated and shall be found within the program paryner shops.

SECTION 6. El Unico & La Casa del Habano LOYALTY CARD
The carrying out of the program is achieved by issuing a loyalty card destined to the clients of El Unico and La Casa del Habano shops and who fulfill the conditions mentioned in Section 4. The loyalty card has four variants: Temporary card, Business card, Platinum Card and Diamond Card, each having the characteristics described below.
The card is nominal and is received by the client following the fulfillment of the requirements from the program regulation. The card shall be sent by courier or shall be collected from the program partner locations. The receipt of the card by the client, does not involve from its part any obligation of subsequent purchase or any other cost that involves the production n and delivery to the beneficiary.



Characteristics and benefits:

Temporary Card
One grants to each client creating an account on this website and/or applying for a card in our shops. 
The temporary card is valid for a period of 3 months from the delivery date.
The holder of the temporary card shall receive El Unico newsletter, being thus informed with regard to novelties.
If during the 3 months of validity, the client does not make purchases amounting to RON 1,200 from our entire range of products, except for cigarettes and pipe and roll tobacco, the card shall be automatically closed /cancelled.
If during the 3 months of validity, the client makes purchases amounting to RON 1,200 from the above mentioned range of products, he shall be classified for the next type of card, meaning Business Card.

Business Card
•    Monthly Newsletter;
•    Discount of 3% for any of the products participating to the loyalty program (S.T. Dupont/cigars/Beverages/Cigar Accessories /Pipe) in El Unico & La Casa del Habano shops;
•    Points based on  purchases (1 point for each leu);
•    Information on the new products/limited editions/vintage cigars;
•    Invitations to special events;
•    Possibility of reserving products.
Business members shall become Platinum members after purchasing products amounting to RON 6,500, in a period of 6 months form the receipt of the Business card OR after having made purchases amounting to RON 19,500 in 2 years from the receipt of the Business card.

Platinum Card
•    Monthly Newsletter;
•    Discount of 3% for any of the products participating to the loyalty program (S.T. Dupont/cigars/Beverages/Cigar Accessories /Pipe) in El Unico & La Casa del Habano shops;
•    Points based on  purchases (1 point for each leu);
•    Information on the new products/limited editions/vintage cigars;
•    Invitations to special events;
•    Possibility of reserving products;
•    Monthly selections of cigars (special price);
•    Monthly "Extra discount" to the selected products up to 10%;
•    The first 5 Platinum members shall have the possibility to request customized engraving on a S.T. Dupont product;
•    Special Discounts in the partner organizations (HORECA & shops);
•    El Unico shall help to the organization of the travel to Habanos Festival from Cuba.

Platinum members shall become Diamond members after having purchased products amounting to RON 50,000, in a period of 1 years from the receipt of the Platinum card.

Diamond Card
•    Monthly Newsletter;
•    Discount of 3% for any of the products participating to the loyalty program (S.T. Dupont/cigars/Beverages/Cigar Accessories /Pipe) in El Unico & La Casa del Habano shops;
•    Points based on  purchases (1 point for each leu);
•    Information on the new products/limited editions/vintage cigars;
•    Invitations to special events;
•    Possibility of reserving products;
•    Monthly selections of cigars (special price);
•    Monthly "Extra discount" to the selected products up to 10%;
•    The first 5 Platinum members shall have the possibility to request customized engraving on a S.T. Dupont product;
•    Special Discounts in the partner organizations (HORECA & shops);
•    El Unico shall help to the organization of the travel to Habanos Festival from Cuba
•    Free delivery of the ordered products;
•    Reservation of the Cuban torcedor, for free, one day per year;
•    Personal cigar box in La Casa del Habano;
•    The top holder of the Diamond card shall be invited at Habanos Festival from Cuba, and El Unico shall bear 50% of the total costs.

The reservation of the products shall be exclusively made by e-mail at the following addresses:

Product shall be reserved for 24 h.
Benefits shall be granted only to active members.

 
SECTION 7. UTILIZATION OF El Unico & La Casa del Habano LOYALTY CARD
Before the shop staff begins to enter the products by the cash register, the client must inform that he holds such card. On the ticket the applied discount shall be printed, according to the held card.
The system is centralized for all El Unico and La Casa del Habano shops in the country and in all the program partner locations.

SECTION 8. DAMAGED, LOST OR STOLEN CARDS
In case of damage, theft or loss of a card one must immediately notify one of the shops, on the telephone or by email on the contact data displayed on the sites. Once notification is given, one shall communicate the name, address and the other identification data of the card holder. In these situations, the participant has the right to a new card. Until the replacement of this card, one shall ne be able to access its benefits. The receipt of the new card shall be made within maximum 30 days from the notification of the loss, theft or damage.
The forgery of any card is punished according to the laws.
 
SECTION 9. RELATION WITH CLIENTS
The card holders can obtain information regarding the functioning of the program and the utilization of the card in any of El Unico and La Casa del Habano shops, on the sites in the program, by telephone and e-mail. By the very same means of communication, the holder of the card shall announce, without delay, any change of personal information, including the address changes.
For the purpose of protecting personal data, the client services shall request certain information in order to establish the client’s identity.

SECTION 10. OFFICIAL REGULATION
The official regulation is available for consulting on a free basis to any participant to the program in all El Unico and Casa del Habano shops, but also in the shops of the agreed partners. For additional information, one can access the addresses on the site in the program. By participation, the clients agree to comply with the terms and conditions of the hereby Official Regulation.
The Organizer reserves the right to amend, change the hereby Official Regulation or to terminate the program, and these changes shall become effective only after the prior information of the clients, at least 15 days before.
The termination decision shall be displayed in El Unico and La Casa del Habano shops in a place that is visible and on the sites too.
